Welcome to AuraCurrency (the "App"), operated by Jan Hamsch und Kai Hamsch GbR ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the App and its services. By downloading, installing, or using AuraCurrency, you agree to these Terms. If you do not agree, please refrain from using the App.

2. Description of the App

AuraCurrency is a mobile utility application designed for travelers, providing real-time currency conversion and an AI-powered camera translator for reading foreign menus, receipts, and price tags. The App offers two tiers: a Free plan with basic features (including a limited number of camera scans, supported by ads) and a Pro plan (monthly or yearly subscription) that unlocks unlimited camera translations (subject to a Fair Use Policy), removes ads, and provides an offline mode for the manual currency converter.

3. Acceptance of Terms

By using AuraCurrency, you confirm your acceptance of these Terms and our Privacy Policy. These Terms form a binding agreement between you and us.

4. Eligibility

You must:

  • Be at least 16 years old to use this App.
  • Own or have permission to use a compatible mobile device.
  • Have an internet connection and enable Camera access to utilize the App's core translation features.

5. Account Registration

  • You may need to create an account to use certain features of the App.
  • You are responsible for keeping your account credentials secure and for all activities under your account.

6. Service Accuracy and Reliability

6.1 Currency Exchange Rates:The exchange rates provided by AuraCurrency are sourced from third-party financial data providers and are for informational purposes only. While we strive for accuracy, we do not guarantee the real-time exactness of any rates. You are solely responsible for any financial decisions or transactions made based on the App's data.

6.2 AI Camera Translations: The App utilizes artificial intelligence to recognize and translate text and prices from images. Factors such as poor lighting, handwriting, or unusual fonts may result in inaccurate translations or incorrect price conversions. We do not guarantee 100% accuracy of any AI-generated translation.

7. Subscription and Payment

7.1 Subscription Plans:
  • Free Plan: Access to the live currency converter and a restricted daily limit of AI camera scans, supported by advertisements.
  • Pro Plan: A monthly or yearly subscription unlocking ad-free usage, offline mode for the currency converter, and unlimited camera scans. Note: "Unlimited" is subject to a Fair Use Policy to prevent automated abuse and protect server integrity. Exceeding humanly possible daily scan limits may result in temporary pauses of the translation feature.

7.2 Payment Terms: Payments are processed via the Apple App Store or Google Play Store platforms, depending on your device, and are subject to their terms and conditions. Subscriptions auto-renew unless canceled at least 24 hours before the billing cycle ends. Prices include applicable taxes (e.g., VAT).

7.3 Cancellation: You can cancel your subscription at any time. The cancellation becomes effective at the end of the current billing cycle. You retain access to Pro features until the end of the already paid period.

7.4 Refunds: No refunds are provided for unused subscription periods, except where required by law. For In-App Purchases, please contact Apple or Google (e.g., reportaproblem.apple.com) to request a refund.

8. License to Use the App

We grant you a non-exclusive, non-transferable, revocable license to use AuraCurrency for personal, non-commercial purposes, subject to these Terms.

9. User Content and Image Processing

  • You retain ownership of the images you capture using the App.
  • By using the camera translation feature, you grant us a temporary license to process your captured images through our third-party AI providers solely for the purpose of delivering the translation service back to you. These images are not stored permanently on our servers or published publicly.
  • You must not use the camera feature to capture illegal or highly sensitive personal data.

10. Intellectual Property

AuraCurrency, including its code, design, logos, and all features, is owned by Jan Hamsch und Kai Hamsch GbR or our licensors. You may not reproduce, modify, or distribute the App without permission.

11. Prohibited Conduct

You may not:

  • Use the App for illegal purposes or to promote illegal activities.
  • Attempt to bypass, hack, or manipulate the Fair Use Policy or scan limits.
  • Use automated scripts, bots, or scrapers to send images to our API or extract exchange rate data.
  • Attempt to reverse-engineer or disrupt the App's functionality.

12. Third-Party Services

AuraCurrency relies on third-party services, including financial data APIs for exchange rates, cloud hosting (e.g., Firebase), and Artificial Intelligence providers for image processing. We are not liable for their performance, inaccuracies in their data, or service outages. Third-party terms and privacy policies apply to their use.

13. Privacy

Your data is handled per our Privacy Policy, which complies with GDPR and other applicable laws. To function properly, the App requires access to your device's Camera. Please refer to our Privacy Policy for details on how your data and images are processed.

14. Updates and Modifications

We may update AuraCurrency or these Terms at any time. Updates will be posted with a revised "Last Updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

15. Termination

We reserve the right to suspend or terminate your access, ban your device, or delete your account for violating these Terms (especially for abusing the API or AI scan limits), with or without notice. Upon termination, you lose access to all App features and Pro benefits.

16. Warranty Disclaimers

AuraCurrency is provided "as is" without warranties, express or implied. We do not guarantee the availability, accuracy, or reliability of the App, the exchange rates, or the AI translations.

17. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages (e.g., financial losses due to inaccurate exchange rates or translations) to the fullest extent permitted by law. Our liability is limited to amounts paid by you in the prior 12 months.

18. Indemnification

You agree to indemnify us against claims arising from your use of AuraCurrency or your violation of these Terms.

19. Governing Law

These Terms are governed by German law, excluding conflict of law rules.

20. Dispute Resolution

Disputes shall be resolved in the courts of Freiburg, Germany, unless consumer protection laws dictate otherwise.

21. Force Majeure

We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, server outages, third-party API failures).

22. Severability

If any provision of these Terms is invalid, the remaining provisions remain enforceable.

23. Entire Agreement

These Terms, along with the Privacy Policy, constitute the full agreement between you and us.

24. No Waiver

Our failure to enforce any right does not waive that right.

25. Assignment

You may not assign these Terms without our consent. We may assign them freely.

28. Language

These Terms are provided in English. Any translations are for convenience; the English version prevails. By using the App, you confirm that you understand and agree to these Terms in English.
